Foreign Investors in U.S. Real Estate

When purchasing property in the U.S., many banks and title agencies require a U.S. tax ID number. This can be applied for with the IRS using form W-7 Application for Federal ID number. You can get the form yourself at the following web site http://www.irs.gov/formspubs/index.html or the staff at Baldwin Accounting can assist you in preparing this form accurately to reduce the chances of delay.

If you do purchase a Real Estate property and rent it out, then you are required to file for 1040NR if you are not a resident of the United States. You may also have other forms to file annually depending in where your property is located.

You should be aware that in the U.S., if a foreign resident sells Real Estate in the United States, the IRS requires that 10% of the sales price needs to be withheld from the sale and sent to the IRS. There are ways to reduce this amount, but it must be planned out ahead of time. Baldwin Accounting can assist you in keeping this withholding amount to the minimum required under the law, which in some cases is zero.
